An umowa najmu okazjonalnego is an ordinary written residential lease plus three mandatory annexes plus one notification to the tax office — and only the complete set gives the landlord simplified eviction based on a notarial deed, bypassing the court case for possession. The legal basis is art. 19a–19e of the Act of 21 June 2001 on the protection of tenants’ rights, municipal housing stock and amendments to the Civil Code (consolidated text Dz. U. 2023 poz. 725). This guide is written for the owner letting a flat in Kraków — including a non-resident foreign owner — and for the tenant who has just been handed such a contract to sign. Below: the entry conditions, the three annexes and which one needs a notary, the costs, the 14-day notification and the price of missing it, how the regime compares with ordinary and institutional leases, how eviction actually works, and an honest list of the drawbacks.

The four entry conditions
None of them can be worked around. If any is missing you have an ordinary lease, even if the document is titled umowa najmu okazjonalnego.

A deposit may be taken, but no more than six months’ rent at the rate applicable on the day the contract is signed; it is returned within one month of the flat being vacated, less the landlord’s claims (art. 19a ust. 4 and 5).
The reward for the paperwork is specific. Only selected provisions of the Tenants’ Rights Protection Act apply to an occasional lease: art. 2, art. 6 ust. 3, art. 10 ust. 1–3, art. 11 ust. 2 pkt 1–3, art. 13, art. 18 ust. 1 and 2, art. 19a–19d and art. 25d pkt 2 (art. 19e). Neither art. 14 nor art. 16 is on that list — the court does not rule on entitlement to a social lease, and the ban on enforcing evictions between 1 November and 31 March does not apply. Art. 25d pkt 2 adds the exclusion of the right to temporary accommodation. All of it, however, is conditional on the notification under art. 19b ust. 1 having been filed.
The three mandatory annexes — and the one at the notary

Practical points that matter:
- Only annex 1 goes to the notary. The lease itself needs no notarial form — plain writing suffices. Listings advertising “umowa najmu okazjonalnego at the notary” confuse the contract with the declaration.
- Annex 1 is an enforcement title. A notarial deed in which the debtor submits to enforcement of the obligation to hand over a specifically identified object is an enforcement title under art. 777 § 1 pkt 4 of the Code of Civil Procedure — which is exactly why the possession claim can be skipped.
- Ask for a certified signature on annex 3. The statute gives the landlord that right expressly (art. 19a ust. 2 pkt 3) and it is cheap: the maximum fee for certifying a signature on a document whose subject is not expressed as a sum of money is PLN 20 net (§ 13 pkt 1 lit. b of the Justice Minister’s regulation on maximum notarial fees, consolidated text Dz. U. 2024 poz. 1566).
- Verify the address in annex 2. The tenant need not already hold legal title to it when the lease is signed — the owner’s consent in annex 3 is enough, and in practice that consent is what creates the title (a loan for use, użyczenie), because it is what the bailiff relies on at the enforcement stage (art. 1046 § 4 CCP). So the consent has to be real and verifiable: that is where the bailiff is supposed to move the debtor, so the flat must exist and be habitable.
What the notary costs
The statute caps the price itself: the notary’s fee for drawing up this declaration is no more than one tenth of the minimum wage (art. 19a ust. 7). The 2026 minimum wage is PLN 4,806 (§ 1 of the Council of Ministers’ regulation of 11 September 2025, Dz. U. 2025 poz. 1242).

These are ceilings, not fixed prices, and 23% VAT is added to all of them. The statute does not say who pays. In practice the tenant does — it is their declaration — but splitting the cost can be agreed in the contract, and it is worth writing down: this is the single most common friction point at signing.
The 14-day tax-office notification
The landlord notifies the head of the tax office competent for the landlord’s place of residence that the lease has been concluded, within 14 days of the day the tenancy starts (art. 19b ust. 1). Three details people trip over:
- The clock runs from the start of the tenancy, not from signature. Signed on 20 August, keys handed over on 1 September — the notification is due by 15 September.
- There is no official form. It is an ordinary letter with the parties’ details, the address of the flat, the date of the contract and the start date — filed in person, by registered post or through the e-Urząd Skarbowy portal.
- Keep the confirmation. You must show it to the tenant on request (art. 19b ust. 2) and, more importantly, it is attached to the application for an enforcement clause (art. 19d ust. 4 pkt 3).
The sanction bites immediately. Where the duty is not met, “art. 19c and art. 19d do not apply” (art. 19b ust. 3), and art. 19e makes the whole special regime conditional on the notification. The lease remains valid but loses every landlord-protective effect: the notarial deed will not produce an enforcement clause, art. 14 and art. 16 return, and so does the right to temporary accommodation. You are back to an ordinary possession claim.
Does a late notification rescue anything? The statute is silent and commentators split — some read the regime as reviving from the date of filing, others as permanently lost for that contract. The point is unsettled, so treat the 14 days as final; if you have already missed it, the safer route is usually to terminate and sign a new lease together with a new notarial declaration.
Tax treatment is unaffected: an occasional lease is taxed with the same lump-sum ryczałt — 8.5% of income up to PLN 100,000 a year and 12.5% above that. The practical dividing line is one question: are you letting as a private individual or as a letting business? A private owner with one or two flats in Kraków chooses between the ordinary and the occasional lease; the institutional lease is closed to them because it requires a registered letting business. Conversely, a company managing a portfolio cannot use the occasional lease — its route is the institutional one, which needs no fallback flat and no tax-office notification, and lets the deposit be replenished on the strength of the statute alone.
How eviction actually works
- The lease expires or is terminated — at the end of the fixed term or after the notice period (art. 19d ust. 1).
- Demand to vacate. If the tenant does not leave voluntarily, the landlord serves a written demand bearing an officially certified signature (in practice, at a notary — max PLN 20 net). It must identify the parties, state the lease and the reason the relationship ended, and set a deadline of no less than 7 days from service (art. 19d ust. 2 and 3).
- Application for an enforcement clause on the annex-1 notarial deed, once that deadline passes unheeded. Attached: the demand with proof of service (or of posting by registered mail), a document proving legal title to the flat, and the tax-office notification confirmation (art. 19d ust. 4). Court fee: PLN 50 (art. 71 pkt 1 of the Act on court costs in civil cases). The court is to decide immediately and no later than 3 days (art. 781¹ CCP) — an instructional deadline that in practice runs longer.
- Bailiff enforcement. The fixed fee for an application to enforce the vacating of premises serving the debtor’s housing needs is PLN 1,500 (art. 34 ust. 1 of the Act on bailiff costs, consolidated text Dz. U. 2024 poz. 377). The bailiff calls for voluntary compliance and then removes the debtor to the flat named in annex 2, provided the debtor holds legal title to it (art. 1046 § 4 CCP) — a title that normally arises from the annex-3 consent itself, which operates as a loan for use. If there is no such flat and the right to temporary accommodation is excluded — as it is for a notified occasional lease (art. 25d pkt 2) — the bailiff removes the debtor to a night shelter or hostel indicated by the municipality (art. 1046 § 5¹ CCP).
Until the flat is vacated, occupants without legal title owe compensation equal to the rent the owner could have obtained, plus supplementary compensation if that does not cover the loss (art. 18 ust. 1 and 2, applied via art. 19e).
Realistically: the occasional lease removes a possession trial that can take a year or more, but it does not make eviction free or instant. Budget several months and around PLN 1,550 in fees, before any lawyer.
If the fallback flat is no longer available
This happens more often than landlords expect: the owner of the fallback flat sells it, dies, withdraws consent, or their own lease ends.
The statute deals with it directly. If the tenant loses the ability to live in the flat named in annex 2, they have 21 days from learning of it to nominate another flat and produce the consent of its owner (art. 19a ust. 3). The sanction is termination: the landlord may then terminate in writing on at least seven days’ notice (art. 19d ust. 5).
Two takeaways. First, write the duty into the contract so the tenant knows about it and the art. 19d ust. 5 termination is not a surprise (§ 10 pt 4 in our template). Second, a new nomination is a new annex to the same contract, not a new contract: the notarial deed keeps its force, because it concerns the obligation to vacate the rented flat, not the address the tenant moves to.
What to check before signing
- A fixed-term lease cannot be terminated at will. Under art. 673 § 3 of the Civil Code, a fixed-term lease may be terminated only in the cases set out in the contract itself, on top of the statutory grounds in art. 11 ust. 2 pkt 1–3 (applied via art. 19e). List your termination grounds in the contract, or you will be left with just those three.
- Rent arrears do not bite on day one. Terminating for late payment requires arrears of at least three full payment periods, a written warning of the intention to terminate, and an additional one-month deadline to pay (art. 11 ust. 2 pkt 2). The occasional lease does not shorten that — it shortens what happens after termination.
- A lease without the full set of annexes is an ordinary lease. The title changes nothing; the same goes for a missed tax-office notification.
- The notarial deed must relate to this specific contract — naming the parties, the flat and the lease relationship.
- Deposit: six months’ rent is a ceiling, not a norm. And spell out whether you may cover current arrears from it during the term — the occasional-lease rules do not provide for that (unlike the institutional lease, art. 19f ust. 7–8), so without a clause the deposit is only settled after the flat is vacated (art. 19a ust. 5).
- A handover protocol with meter readings — without it, settling the deposit becomes an argument about words.

Ponadto, w razie niedopełnienia przez Najemcę obowiązku z art. 19a ust. 3 ustawy (§ 10 ust. 4 niniejszej umowy), Wynajmujący może wypowiedzieć umowę na piśmie z zachowaniem co najmniej siedmiodniowego okresu wypowiedzenia (art. 19d ust. 5 ustawy). Inne umowne przyczyny wypowiedzenia i termin wypowiedzenia: [__________].
Po wygaśnięciu lub rozwiązaniu umowy, jeżeli Najemca nie opróżni lokalu dobrowolnie, Wynajmujący doręcza Najemcy żądanie opróżnienia lokalu sporządzone na piśmie opatrzonym urzędowo poświadczonym podpisem Wynajmującego, wyznaczając termin nie krótszy niż 7 dni od dnia doręczenia żądania (art. 19d ust. 2 i 3 ustawy). § 9. Zgłoszenie do urzędu skarbowego
Wynajmujący zgłasza zawarcie niniejszej umowy naczelnikowi urzędu skarbowego właściwemu ze względu na miejsce zamieszkania Wynajmującego, w terminie 14 dni od dnia rozpoczęcia najmu (art. 19b ust. 1 ustawy). Na żądanie Najemcy Wynajmujący przedstawia potwierdzenie dokonania zgłoszenia (art. 19b ust. 2 ustawy). Niedopełnienie tego obowiązku skutkuje utratą szczególnych, ochronnych dla Wynajmującego skutków najmu okazjonalnego przewidzianych ustawą (art. 19b ust. 3 ustawy).
§ 10. Załączniki — obowiązkowe elementy najmu okazjonalnego
Zgodnie z art. 19a ust. 2 ustawy integralną częścią niniejszej umowy są następujące załączniki, bez których umowa nie wywołuje szczególnych skutków najmu okazjonalnego:
- Oświadczenie Najemcy o poddaniu się egzekucji i zobowiązaniu do opróżnienia i wydania lokalu w terminie wskazanym w żądaniu Wynajmującego — sporządzane wyłącznie w formie aktu notarialnego u notariusza; niniejszy wzór go nie zastępuje.
- Wskazanie przez Najemcę innego lokalu, w którym będzie mógł zamieszkać w przypadku wykonania egzekucji obowiązku opróżnienia lokalu. Adres lokalu wskazanego przez Najemcę:

W sprawach nieuregulowanych niniejszą umową zastosowanie mają przepisy Kodeksu cywilnego oraz ustawy o ochronie praw lokatorów, mieszkaniowym zasobie gminy i o zmianie Kodeksu cywilnego.
